By accessing and using the BetterPick mobile application ("App") and website, you accept and agree to be bound by these terms. If you do not agree, please do not use the service.

2. Description of Service

BetterPick is a mobile application that provides AI-powered product analysis and sustainability insights. Scan results use plain-language verdicts — Good, Mixed, and Caution — not numeric scores. The service helps you review ingredients, allergens, environmental impact, and related label information.

3. User Accounts

To use certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App to:

• Upload or transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Violate any applicable laws or regulations

5. Privacy and Data

The App and its original content, features, and functionality are owned by BetterPick and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. User Content

By uploading images or submitting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze such content for the purpose of providing our services. You represent and warrant that you have all necessary rights to grant this license.

8. Disclaimers

The information provided through the App is for informational purposes only and should not be considered as professional advice. We do not guarantee the accuracy, completeness, or reliability of any information obtained through the App. Always consult with qualified professionals for health, dietary, or environmental decisions.

9. Limitation of Liability

To the maximum extent permitted by law, BetterPick shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the App.

10. Indemnification

You agree to defend, indemnify, and hold harmless BetterPick and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately.

12. Governing Law

These Terms shall be governed by the laws applicable in your region of use, without regard to conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

15. Subscriptions (BetterPick Plus)

BetterPick Plus is an optional auto-renewing subscription that provides additional features such as unlimited scans. If you purchase a subscription:

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase
• The subscription renews automatically unless canceled at least 24 hours before the end of the current billing period
• Your account is charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription in your device's App Store or Google Play subscription settings
• You can restore prior purchases using Restore Purchases in the app
• Pricing and availability may vary by region; the price shown at purchase applies to your transaction

16. Effective Date

These Terms of Service are effective as of January 1, 2024, and will remain in effect except with respect to any changes posted in the app or on this page.
